ReplyDeleteI had purchased a car, Citroen C3 and availed a loan through Kotak prime Ltd. At the time I had also filed for divorce as my wife started becoming violent. The loan amount availed was Rs.6,80,000. I had been paying the loan on time up until the finalization of my divorce where my wife asked for everything but she had no clue of the car purchase. For preserving my sanity, I gave her everything and had a job. After the finalization of divorce, I suffered mentally and lost my job, thus came end of 2024 and this is when i started defaulting on the Car loan. I called Kotak and received calls from Kotak but cases were open and closed, I emailed Kotak, the ceo, the legal council, the Nodal Officer who were willing to look at the behavior of Kotak employees but not help restructure my loan. I finally went to the Kotak office in Noida and was asked to wait, only to have my number never called and at closing day, they said it was a glitch and to come back again, I couldn't.
ReplyDeleteIn addition, I had a Kotak Credit card which I also started defaulting on and since the I.T. market has been bad, I haven't been able to get a job, believe me I've tried and still am, everyday. Kotak refused to answer my emails and my requests for help fell on dead ears, then they put a lien on my savings account for the credit card. Whatever freelance work I could find, I did and earned whatever and tried to pay Kotak prime and Kotak Credit Card. I asked them for a settlement which they never gave for the credit card and then whatever amounts I earned was going towards the credit card. Eventually I had to pull my epf balance, half of which was credited and they refused to release my lien on the account even though there was only 30k remaining for the credit card. However, because the accounts were in Lien they kept adding charges and interest even though they said the account has been sold to a 3rd party. This amounted to again 1lakh and finally I got my tax refund which they deducted completely even though I requested them to please split the amounts for the car and the credit card, they refused.
Finally having closed off my credit card, I asked my parents(not well off) to pay a few months of my car loan, they did but stopped after 4 payments. I raised another request for my EPF and kept informing Kotak of the issue but no ticket was documented and cases were open and closed with no resolution. In the meantime Kotak raised and sent notices of arbitration to me, sent people to my house for collections and I kept everyone informed of the situation but they weren't speaking to each other. When I finally got my EPF I started paying back the loan as much as possible and they apparently did the arbitration without me, sent me a postal mail and have repossessed my car. I don't have money to afford a lawyer but I really want justice, is there anything I can do?
